  1. Preamble

    1. This document describes the Terms of Use for the services provided by GARDOS SOFTWARE LTD, a company registered in Bulgaria with its registered office at Str. Malashevska №1, Sandanski 2800, Blagoevgrad, Bulgaria (the "Company").
    2. Usage of this website constitutes acceptance of the Terms of Use described herein.

  2. Privacy

    1. Your privacy is important to us, and so is being transparent about how we collect and use information about you.
    2. Your personal data and how we use them
      1. The following data are collected in order to create an account on our website
        1. Email address
          1. Your email address is necessary in order for you to sign in on our website.
          2. We will use your email address in order to send you important alerts concerning your account such as a License expiring, Password change request, Payment made, Invoices etc.
          3. We will only send you promotional Newsletters if you have accepted (checked the appropriate checkbox) to receive them when you signed up.
        2. Password
          1. Your password is stored securely in a non-readable format (Technical term: Salted Password Hashing) for the sole purpose of your authentication.
        3. IP Address
          1. Your IP Address is stored for security and statistical reasons.
        4. Browser Information
          1. Your Browser information is stored for security and statistical reasons.
      2. All or some of the following personal data may be collected when you make a payment on our website
        1. Full Name, Company Name, Billing Address, Phone number, TAX Registration Number, TAX Registration Office, Occupation
          1. We only use these data for billing and invoicing reasons.
    3. Sharing of personal data
      1. We do not sell your personal data to anyone.
      2. We share personal data only with the service providers listed below, and only to the extent necessary to provide our services
        1. Payment processing: card and PayPal payments are processed by PayPal. Wire transfer payments are processed by the banking/payment institutions involved in the transfer. Your card details or PayPal credentials are handled entirely by PayPal and are never received or stored on our servers. Information required to complete a transaction (such as the order amount and payment reference) is shared as needed to process and reconcile the payment.
        2. Bot protection: our public forms are protected by Cloudflare Turnstile, which processes technical connection data in order to distinguish humans from bots.
        3. Email delivery: transactional emails (and Newsletters, if you have opted in) are sent through our email delivery providers, which process your email address for that purpose.
        4. Hosting and content delivery: our website and downloads are served through hosting and content delivery network (CDN) providers, which may process technical data (such as IP addresses) as part of normal operation.
    4. Protection of personal data

      2. In order for users to request data deletion or export, they must contact us by email with their request. We respond to all enquiries within 15 days.

  4. Purchases and refunds

    1. Applicable taxes are calculated automatically and included in the final price.
    2. Payments are processed by PayPal or SWIFT wire transfer. Upon confirmation of payment, your license (serial number) is delivered electronically to your account and by email.
    3. Right of withdrawal
      1. Our products are digital content that is not supplied on a tangible medium. By completing a purchase, you expressly consent to the immediate delivery of the digital content (license key and download) and acknowledge that you thereby lose your right of withdrawal under the EU 14-day withdrawal rules once delivery has begun.
      2. Nothing in this section affects any statutory rights that cannot be waived under applicable law.
    4. If you experience any problem with a purchase or delivered license, please contact us and we will do our best to resolve it.

  5. Software licenses

    1. Software products downloaded from or purchased through this website are licensed, not sold, and their use is governed by the applicable license agreement, which is presented for acceptance before download or purchase
      1. Desktop applications are governed by the End-User License Agreement.
      2. Developer components (SDKs) are governed by the Developer License Agreement.
    2. In the event of a conflict between these Terms of Use and the applicable license agreement with respect to the use of the software itself, the license agreement prevails.

  6. Intellectual property

    1. All the content of this website (with the exception of copyrights of third parties, partners, institutions, user content and dynamically generated content), including pictures, graphics, photographs, drawings, texts provided services and overall all the files of this website are property, trademarks and logos of the Company and are protected by the European and International laws and conventions. Consequently, none of those can be sold, copied, modified, reproduced, reprinted, uploaded or transmitted in any way, either in part or in total. Excluded from this clause is the case where a user / visitor, stores one and only one copy of part of the content in their device (Personal Computer, Laptop, Tablet, Mobile Phone) for personal use only, without deletion of the origin of the content from our website. Other products and services mentioned in the pages of the site that bear the logos of companies, organisations and other third parties are their intellectual properties and they bear all relative responsibility.
    2. The Company does not claim ownership over any User Content submitted on or through the Service. Your User Content belongs to You.
    3. Dynamically generated content retains the ownership of any intellectual property rights the source content had.

    2. Under no circumstances will Company be liable in any way for any loss of profits, loss of data, business disruption or other damages that may result from the use of its services.
